Terms and Conditions for Web Hosting Services

By using GoodHosting.ca services, you agree to be bound by and to comply with this Agreement, just as if you had signed it. Violation of any provision of this Agreement is grounds for immediate termination of your GoodHosting.ca account.

Use of Material

The accountholder is solely responsible for the content of Web pages owned by the account.

All services may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute.

Examples of non-acceptable content:

Pornography and sex-related merchandising
Gambling sites (depending on your state laws)
Pirated software
Hackers programs or archives
Warez Sites
IRC Bots
Illegal Distribution Of Un-Owned Mp3
Sites that promote any illegal activity

This also includes links or any connection to such materials.

GoodHosting.ca does not monitor and is not obligated to monitor the Content on Customer's Website.

If GoodHosting.ca becomes aware of a violation of the Agreement, GoodHosting.ca will investigate and may, in its sole discretion, terminate hosting under the Hosting Agreement.

CGI Scripts

Each account comes with its own CGI-BIN. You are free to use any CGI scripts you wish, however we reserve the right to disable any CGI script that effects normal server operation.

IRC

We currently do not allow IRC or IRC bots to be operated on our servers.

Commercial Advertising - Email

Our servers may not be the source, intermediary, or destination address involved in the transmission of spam, flames, or mail bombs. Unsolicited advertising mailings, whether commercial or informational, are strictly prohibited. We consider spam any mass unsolicited message in the mediums of Email. If you are found to have spammed, then we will immediately, without warning, disable your domain. We reserve the right to refuse or cancel service to known spammers. Lastly, we reserve the right to determine what violates this policy.

As such, any violation will result in immediate deactivation of services without refund.

Payment of fees

Current monthly and set-up fees for GoodHosting.ca services can be found on the GoodHosting.ca site found at http://GoodHosting.ca.

GoodHosting.ca services are offered on a pre-pay basis. Payment for a minimum of one month of services must be received prior to the proceeding month's start date. Accounts that do not abide to the payment terms set forth herein are subject to suspension and/or account termination. You acknowledge responsibility that, even if your account is terminated, you will be held liable to for any balance owed on the account.

GoodHosting.ca reserves the right to charge a setup fee to reinstate suspended or terminated accounts.

There is a $15.00 service charge for each returned check.

If you believe GoodHosting.ca has billed you incorrectly, you must contact GoodHosting.ca no later than 60 days after the date on the first billing statement in which the error or problem appeared, in order to receive an adjustment or credit. Inquiries should be directed to GoodHosting.ca's billing department (Billing@GoodHosting.ca), and should include all available information about the suspected error.

If you have elected to have GoodHosting.ca make automatic payments against your credit card, and your credit card expires, GoodHosting.ca, in its discretion, may either assume that your card has been renewed for one year, or require that you furnish updated credit card information, including the new expiration date and any other information needed to process your account payments. If GoodHosting.ca is unable to obtain payment from your credit card bank because you have not renewed your card, because your credit card information has become outdated, or because you have not provided new information to GoodHosting.ca when requested, GoodHosting.ca may consider your account to be delinquent by more than one accounting cycle and suspend, archive or purge your account.

30 Day Money Back Guarantee

Each of our hosting accounts carries a 30-day money back guarantee. If you are not completely satisfied with our hosting services within the first 30 days of service, you will be given a full refund of the initial amount billed excluding any set-up or domain registration fees.

Provision of Services

GoodHosting.ca reserves the right to discontinue any and all services to you at any time, without prior notice or liability, for any conduct which GoodHosting.ca, in its sole discretion, believes violates the Agreement, or is otherwise harmful to GoodHosting.ca's interests or the interests of other accountholders.

Certain services performed by GoodHosting.ca may require passing personal information about GoodHosting.ca accountholders to third parties. Services include, but are not limited to, registering information with the InterNIC for those accountholders who wish to own their own Internet domain name. GoodHosting.ca can not be held responsible for the lack of privacy that these third party entities may offer.

GoodHosting.ca reserves the right to obtain, lease and utilize the products and services of third party vendors in order to maintain services to it accountholders.

Server Abuse

Any attempts to undermine or cause harm to a server is strictly prohibited.

Refusal of Service

GoodHosting.ca reserves the right to refuse or cancel service at our sole discretion. If any terms or conditions are failed to be followed it will result in grounds for immediate account deactivation.

Liability

You acknowledge that GoodHosting.ca services are provided "as is".

We are responsible to the present owner of the web hosting space. It is our goal to keep your account up and running 99.9 % of the time. We can not and no web hosting company can guarantee 100% to always be operational. Even the best backup system, and the top quality servers, which we know that we have, can be without the possibility of malfunction and down time in internet service. If any links in our internet server loses access with the world wide web we will do our best to reestablish it as soon as possible. We are NOT responsible for any loss of sales if the server is down for any period of time.

We do our best to verify ownership of web hosting accounts by credit card number (if paid for by credit card), name, address, user name, password. If you give this information to any other party, you risk having your web site and any other information on your account changed and/or deleted. We are not responsible for any information on your account should you reveal this information.

Passwords

Each GoodHosting.ca account user is responsible for the security of his or her password(s). Secure passwords are between 6 and 8 characters long, contain letters of mixed case and non-letter characters, and cannot be found in whole or in part, in normal or reverse order, in any dictionary of words or names in any language. The accountholder is responsible for changing his or her password(s) regularly.

System Security

The accountholder is prohibited from utilizing GoodHosting.ca services to compromise the security or tamper with system resources or accounts on computers at GoodHosting.ca or any other site. Use or distribution of tools designed for compromising security is prohibited. Examples of these tools include but are not limited to password guessing programs, cracking tools or network probing tools.

We reserves the right to release the users names of accountholders involved in violations of system security to system administrators at other sites, in order to assist them in resolving security incidents. We will also fully cooperate with law enforcement authorities in investigating suspected lawbreakers.

System Resources

System abuse is defined as any use GoodHosting.ca resources which disrupts the normal use of the system or Internet services for others. Examples of system abuse include, but are not limited to, attempting to disrupt the sessions of other Internet users, consuming excessive amounts of CPU time, memory or disk space, or otherwise affecting the performance of GoodHosting.ca servers.

Cancellation of Accounts

To cancel your account, you must contact GoodHosting.ca support via email or postal mail. Cancellation requests must include the account's login name, and your name, address and phone number and other identifying information as they appear in GoodHosting.ca's billing records.

If a GoodHosting.ca account is canceled, suspended or terminated, GoodHosting.ca may maintain the account for 30 days. You may contact GoodHosting.ca within that time to inquire about reopening a suspended account, or forwarding mail or files to another address. GoodHosting.ca reserves the right to refuse to forward the mail and/or files of any account terminated for violation of any provision of the Agreement. If you do not contact GoodHosting.ca within 30 days, your account and associated files will be deleted from GoodHosting.ca's servers, and GoodHosting.ca will not be able to reopen it or restore files. GoodHosting.ca is not responsible for maintaining material that it deletes from its servers as a result of a determination.

Change of Policy

GoodHosting.ca reserves the right to modify the Agreement, and/or modify the prices of its services, as well as discontinue or change the services offered. A notification will be made by email when modifications are made, however, it will be the responsibility of the accountholder to keep informed about these changes.
